Buying or selling a cannabis business in Idaho

Federal and state law current as of September 2026 — verify with counsel.

Idaho has no licensed marijuana market, medical or adult-use, so there are no dispensaries, cultivators or licences to buy or sell. What can lawfully change hands is a hemp growing or handling business licensed by the Idaho State Department of Agriculture under HB 126, a zero-THC CBD retail business, or an ancillary company serving licensed operators in other states.

Key takeaways

  • Marijuana remains fully illegal in Idaho for both medical and adult use, and Epidiolex is the only FDA-approved cannabis-derived medicine available.
  • HB 126, the Industrial Hemp Research and Development Act signed in 2021, made Idaho the last state to allow hemp cultivation, transport and processing.
  • Hemp crops must test at or below 0.3% total delta-9 THC, but finished products sold at retail in Idaho must contain 0.0% THC, which is stricter than federal law.
  • The Natural Medicine Alliance of Idaho submitted more than 150,000 signatures on 1 May 2026 for a November 2026 medical cannabis initiative; county verification ran to 30 June 2026.
  • Ancillary businesses serving out-of-state licensees are ordinary Idaho companies, outside section 280E and generally bankable.

Idaho has no licensed marijuana market

There is nothing to sugar-coat. Idaho permits neither medical nor adult-use marijuana. There is no regulator, no licence, no dispensary, no cultivation permit, and no legal path to operate a plant-touching cannabis business in the state. Marijuana is a controlled substance under Idaho Code chapter 27 of title 37. The only cannabis-derived medicine lawfully available is Epidiolex, the FDA-approved CBD drug.

That also means the April 2026 federal rescheduling order changes nothing here. It reaches marijuana held under a state medical marijuana licence, and Idaho issues none.

A medical initiative is pending. The Natural Medicine Alliance of Idaho submitted more than 150,000 signatures on 1 May 2026 for the Idaho Medical Cannabis Act, with county clerks verifying through 30 June 2026 before the Secretary of State’s determination. Even if it passes, licensing rules would have to be written afterwards. No one should pay for Idaho licence value today.

Hemp: what Idaho does allow, and the retail catch

Idaho was the last state to legalise hemp. HB 126, the industrial hemp bill, was signed on 16 April 2021 and allows cultivation, transport, and processing under licences issued by the Idaho State Department of Agriculture.

Two thresholds matter, and they are different:

StageIdaho THC limit
Hemp crop at harvestNot more than 0.3% total delta-9 THC
Finished product sold at retail in Idaho0.0% THC

A licensed Idaho handler may receive raw hemp at up to 0.3% THC but must process the finished product down to zero. That makes Idaho stricter than the federal standard and stricter than almost every neighbouring state. Any diligence on an Idaho CBD retailer or handler starts with certificates of analysis on every SKU, because non-conforming stock is a criminal exposure, not a labelling error.

The federal ground is also shifting. Under P.L. 119-37, cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026, and the total-THC test, the per-container THC cap, and the converted-cannabinoid exclusion were delayed by one month to 11 December 2026. Because Idaho already bars intoxicating hemp at retail, the commercial damage here is smaller than in states that built a delta-8 trade. What can actually be bought and sold

  • Hemp grower and handler businesses. Real, licensed, transferable agricultural businesses. Value sits in acreage, processing equipment, offtake contracts, and the ISDA licence, and these sell on ordinary small-business terms.
  • Zero-THC CBD retail and e-commerce. Ordinary retail businesses with an unusual compliance file. Inventory testing is the main diligence item.
  • Ancillary companies. Equipment, packaging, software, security, logistics, construction, and professional services sold into licensed markets elsewhere. These are not plant-touching, so 280E does not apply and financing is usually available. See ancillary cannabis businesses and plant-touching vs ancillary investment.

An Idaho resident who wants to own a plant-touching business will have to do it in another state, and in several of those the residency rules will decide where. Montana requires the person with day-to-day operational control to be a resident; Washington and Oregon are the nearest open markets. See ownership caps and residency rules by state.

Trade sources list Idaho among the states reported to require a real estate licence to broker some business sales; we have not confirmed that from the statute. See business broker licensing by state. This page is educational and is not legal advice.

Frequently asked questions

Is there any cannabis licence to buy in Idaho?

Not a marijuana licence. Idaho issues hemp grower and handler licences through the Idaho State Department of Agriculture, and those businesses can be bought and sold like any other agricultural enterprise. There is no dispensary, cultivation, manufacturing, delivery, or testing licence for marijuana because the state has no medical or adult-use programme.

Can I sell CBD products in Idaho?

Only products containing zero percent THC. Licensed Idaho handlers may take in raw hemp at up to 0.3% THC, but the finished product sold in the state must be diluted to 0.0% THC. That rule shapes what a CBD retailer in Idaho can stock and is the first thing to verify in diligence on any Idaho CBD business, because non-conforming inventory is not a minor compliance issue.

Would the 2026 ballot initiative change any of this?

It would create a medical programme, but not immediately and not certainly. Supporters submitted signatures on 1 May 2026 and county clerks had until 30 June to verify them before the Secretary of State made a final determination. Even a passing measure would need a licensing framework built afterwards. Do not pay today for licence value that does not exist.

Does Idaho's position change because of federal rescheduling?

No. The April 2026 federal order applies to marijuana under a state medical marijuana licence. Idaho issues no such licence, so nothing in the order creates a lawful Idaho market. Federal scheduling does not override state prohibition in either direction.

What happens to Idaho hemp businesses under the federal hemp changes?

They face a narrowing of what counts as hemp. Under P.L. 119-37, cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026, and the total-THC test, the per-container THC cap and the converted-cannabinoid exclusion take effect on 11 December 2026. Idaho's zero-THC retail rule already excluded most intoxicating products, so the practical hit here is smaller than in permissive states.
