Buying or selling a cannabis business in Kansas City, Missouri

Federal and state law current as of September 2026 — verify with counsel.

Kansas City, Missouri taxes adult-use cannabis at 3% under Code section 68-451, approved by 73% of voters in April 2023 and collected since 1 October 2023. Its zoning code, section 88-354, treats dispensaries as retail but bars new ones within 2,000 feet of another dispensary, 1,000 feet of a school or 300 feet of a church or daycare, with hours of 8am to 10pm.

Key takeaways

  • Kansas City Code section 68-451, enacted by Ordinance 230362 on 11 May 2023, imposes a 3% tax on adult-use marijuana retail sales, effective 1 October 2023.
  • The city splits that revenue in thirds: neighbourhood clean-up, homelessness response, and violence prevention.
  • Zoning section 88-354, amended by Ordinance 240411 on 12 September 2024, requires 2,000 feet between dispensaries, 1,000 feet from schools and 300 feet from churches and daycares, measured by walking route.
  • Dispensaries are classed as retail sales under section 88-805, a use permitted in the B1 to B4 commercial districts, and must close between 10pm and 8am.
  • Kansas has no medical or adult-use cannabis law, so Kansas-side demand crosses the state line into Missouri stores.

The city’s 3% cannabis tax

Kansas City levies 3% on adult-use marijuana retail sales. Code section 68-451, enacted by Ordinance 230362 on 11 May 2023 under Article XIV, section 2.6(5) of the Missouri Constitution, imposes the tax on sellers at 3% of receipts, effective 1 October 2023 and collected by the state with other local sales taxes. Voters approved it as Question 1 on 4 April 2023, with about 73% in favour. The tax applies to adult-use sales only, so medical sales avoid it.

The ordinance earmarks the money in thirds: neighbourhood clean-up through public works, homelessness response through the housing department, and violence prevention through the health department. The city set up a dedicated Marijuana Sales Tax Fund, No. 2190, by Ordinance 230720 in September 2023.

The city spans Jackson, Clay, Platte and Cass counties. Since the Missouri Supreme Court ruled in July 2025 that only one local government may levy the 3%, the city’s tax is the only local cannabis tax on a store inside city limits, whichever county it sits in. A store that was also charged a county 3% before the ruling has a broken revenue series: normalise trailing results across July 2025 before applying a multiple. The statewide background is on the Missouri page.

Where can a dispensary go?

Kansas City does not have a separate cannabis zoning district. Under section 88-805, comprehensive and medical dispensaries are classified as retail sales, cultivation as crop agriculture, and infused-product manufacturing as limited manufacturing. Retail sales is a permitted use in the B1 to B4 commercial districts in Table 120-1, and not in the O office district. So a dispensary on a compliant commercial parcel needs no special use permit; what it must satisfy is the distance test.

Distance rules and hours under section 88-354

Section 88-354, first adopted by Ordinance 190430 in 2019, updated for adult use by Ordinance 230124 in February 2023 and tightened by Ordinance 240411 on 12 September 2024, sets these rules:

RuleRequirement
Dispensary to dispensary2,000 feet from any then-existing dispensary
Schools1,000 feet from an elementary or secondary school, all facility types
Churches and daycares300 feet, all facility types
MeasurementShortest path lawfully travelled on foot
HoursDispensaries open only 8am to 10pm
OperationsFully enclosed; no dust, noise or other impact beyond the property line

Each distance applies when a facility is initially sited, at the earlier of licence or zoning application. That is the valuation point. An operating store keeps its site even if a school or church later opens nearby, and the 2,000-foot rule, added in 2024, now protects a walking radius around each store from a new competitor. The flip side: a store that must relocate needs a new parcel that clears 2,000 feet from every existing dispensary, which in a built-up corridor may not exist. Read the lease as though the business cannot move; see relocating a licence.

The city’s licence and what a buyer should pull

The cannabis licence is a state licence. The city’s gate is its business licence, which requires a Zoning Clearance for Business License filed through CompassKC with a marijuana affidavit and a map showing the section 88-354 distances. A separate clearance is needed for every location, and the city allows at least five business days for review. Converting a space from another use, such as a restaurant, to a dispensary can require a change-of-use plan review and a new certificate of occupancy. On-site consumption is not permitted in the city.

Ask a seller for the zoning clearance, the distance map filed with it, the business licence, and the certificate of occupancy. Ownership changes are approved by DHSS, not the city, through its business change applications; the fees and timetable are on the state page. The local checklist is in local control and municipal approvals.

The state line is the market

Kansas has no medical or adult-use cannabis law, and its 2026 session adjourned on 10 April 2026 without advancing reform. Missouri-side stores in the metro serve a Kansas population with no lawful in-state option. Ask for customer geography, model the business without out-of-state traffic, and put the legislative risk into the structure, through an earn-out or a lower multiple.

Missouri sold about $1.52 billion of cannabis in 2025, roughly 3% up on 2024. Kansas City stores compete on price and convenience; the 2,000-foot rule gives each a walking radius, not a market.

Practical points for sellers and buyers

Sellers. Show the 2,000-foot radius on a map, the customer-geography analysis, and a tax history split at July 2025. See preparing a cannabis business for sale.

Buyers. Confirm the parcel is inside city limits and in a district where retail sales is permitted, verify revenue against Metrc data, underwrite the Kansas exposure, then price with dispensary valuation multiples.

Frequently asked questions

What is the marijuana sales tax in Kansas City, Missouri?

Kansas City levies 3% on adult-use marijuana retail sales under Code section 68-451, enacted by Ordinance 230362 after 73% of voters approved Question 1 on 4 April 2023. It took effect on 1 October 2023. That sits on top of Missouri's 6% state excise and ordinary sales taxes, and medical sales are not covered by the city's 3%.

How far apart must Kansas City dispensaries be?

Under zoning section 88-354-02, a new dispensary cannot be sited within 2,000 feet of an existing dispensary, within 1,000 feet of an elementary or secondary school, or within 300 feet of a church or daycare. Distances are measured along the shortest lawful walking path. The test applies at the earlier of licence or zoning application, so an existing store is not displaced by a later school.

Does a Kansas City dispensary need a city licence?

It needs a city business licence, and to get one it must first obtain a Zoning Clearance for Business License through CompassKC, filing a marijuana affidavit and a map proving the section 88-354 distances. The city asks for a separate clearance for every location and allows at least five business days for review. The cannabis licence itself is issued by the state, not the city.

How much of a Kansas City dispensary's revenue comes from Kansas?

It varies by location, but the structural point is fixed: Kansas has no legal cannabis market and the state line runs through the metro. Stores nearest the line usually see the highest share of out-of-state customers. Ask any seller for a breakdown by customer ZIP code or payment data and stress-test the business without that traffic.

Who approves the sale of a Kansas City dispensary?

The Division of Cannabis Regulation at the Missouri Department of Health and Senior Services approves ownership changes, not the city. Because the city's distance rules apply only when a facility is initially sited, a change of owner at an existing, compliant location does not reopen the 2,000-foot test, though any relocation or new site would have to meet it.
