For both sides
Buying or selling a cannabis business in Indiana
Federal and state law current as of September 2026 — verify with counsel.
Indiana has no licensed marijuana market. Neither adult-use nor medical cannabis is legal, no state agency issues marijuana business licences, and there is nothing plant-touching to buy or sell. What does change hands in Indiana is hemp and CBD retail and manufacturing, hemp-derived beverage businesses, and ancillary companies that serve licensed operators in other states.
Key takeaways
- Indiana licenses no marijuana businesses; possession remains a criminal offence and no medical programme exists as of September 2026.
- Legalisation and decriminalisation bills were introduced in the 2026 session and none became law; a senator said in May 2026 he was drafting a medical cannabis proposal.
- Indiana lawmakers have said federal rescheduling does not automatically change Indiana law, so the April 2026 Schedule III order does not create an Indiana market.
- The saleable businesses in Indiana are hemp and CBD retail and manufacturing, hemp-derived THC beverage companies, and ancillary suppliers with no plant contact.
- Hemp-derived product businesses face a hard federal date: cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026.
What is legal in Indiana in 2026?
Not much. Indiana has no adult-use market and no medical cannabis programme. No state agency issues marijuana cultivation, manufacturing, or retail licences, and possession remains a criminal offence. Legalisation and decriminalisation proposals were introduced in the 2026 session and none passed. In May 2026 a state senator said he was drafting a state-licensed medical marijuana proposal in response to federal scheduling changes, and Indiana regulators described themselves as awaiting final federal action. Neither is a market.
The federal order of April 2026 placing state-licensed medical marijuana in Schedule III does not create a state programme where none exists. Indiana lawmakers have said as much. See rescheduling status and what it changes.
What can actually be bought and sold here
Three categories, none of them plant-touching under state marijuana law:
- Hemp and CBD retail and manufacturing. Ordinary business sales, but with a federal clock running. Under P.L. 119-37, cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026, while the total-THC test, the per-container cap, and the converted-cannabinoid exclusion were pushed to 11 December 2026. Indiana legislators have also been working on state restrictions for hemp-derived THC products. Diligence detail is on hemp and CBD businesses and intoxicating hemp products: regulatory status.
- Ancillary businesses. Equipment, packaging, software, security, consulting, and logistics companies that serve licensed operators elsewhere. They are financeable in ways plant-touching businesses are not, though SBA still treats some indirect marijuana businesses as ineligible. See ancillary cannabis businesses and why SBA and banks are unavailable.
- Real estate. Buildings positioned for a future programme. That is a speculative land play, not a cannabis business.
If you are an Indiana owner or investor
Indiana borders two licensed markets. Illinois is capped and closely vetted, with a $5,000 change-of-ownership fee and an owner limit of 10 dispensary licences. Michigan is open at the state level, so the municipal permit is where the value sits. Neither requires you to live there, though both run background and financial reviews on every proposed owner: ownership eligibility, background checks, and residency. Illinois stores near the Indiana line already capture a meaningful share of out-of-state spending, which is worth understanding before you assume an Indiana programme would be additive.

Frequently asked questions
Can I buy a dispensary in Indiana?
No. Indiana issues no marijuana retail licences, so there is no dispensary to buy. Indiana residents who want to own a licensed cannabis business generally look at Illinois or Michigan, both of which border the state and both of which vet owners regardless of where they live. Nothing about federal rescheduling changes Indiana's own law.
Is a hemp or THC beverage business in Indiana worth buying in 2026?
It can be, but the federal hemp definition is changing on a schedule that cuts directly into product lines. Cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026, and the total-THC test, the per-container THC cap and the converted-cannabinoid exclusion were delayed to 11 December 2026. Price any Indiana hemp business on what it can lawfully sell after those dates.
Could Indiana legalise medical cannabis soon?
It is being discussed rather than scheduled. A state senator said in May 2026 that he was drafting a state-licensed medical marijuana proposal after federal moves on scheduling, and Indiana regulators have described themselves as waiting on final federal action. Nothing has passed. Anyone positioning for an Indiana licence should treat a launch date as unknown.
What happens to an Indiana business if the state legalises later?
New states almost always run a fresh application process, and existing hemp operators get no automatic priority. What travels is real estate in a compliant location, retail operating experience, brand, and capital. If you own an Indiana property that could host a dispensary, the lease and zoning work matters more than the current business.
