Buying or selling a cannabis business in Iowa
Federal and state law current as of September 2026 — verify with counsel.
Iowa has no adult-use or full medical marijuana market. It runs a narrow Medical Cannabidiol Programme under Iowa Code chapter 124E, administered by the Department of Health and Human Services, with two licensed manufacturers and five licensed dispensaries. Those licences are few and are awarded by the department rather than traded, so most Iowa deal activity is in consumable hemp and ancillary businesses.
Key takeaways
- Iowa's Medical Cannabidiol Programme runs under Iowa Code chapter 124E and is administered by the Bureau of Cannabis Regulation at Iowa HHS.
- Two manufacturers are licensed, MedPharm Iowa in Des Moines and Bud and Mary's in Council Bluffs, alongside five licensed dispensaries.
- The programme allows no smokable flower and caps a patient at 4.5 grams of THC per 90 days, which limits the revenue any licensee can generate.
- Consumable hemp products in Iowa are capped at 4 milligrams of THC per serving and 10 milligrams per container under 2024 House File 2605, with synthetic THC prohibited.
- Because licence numbers are set by the department and no adult-use programme exists, Iowa licence values do not behave like those in a capped adult-use state.
Legal status and regulator
Iowa has no adult-use cannabis market and no broad medical marijuana programme. What it has is the Medical Cannabidiol Programme under Iowa Code chapter 124E, run by the Department of Health and Human Services. The programme is deliberately narrow: no smokable flower, no conventional edibles channel, and a cap of 4.5 grams of THC per patient per 90 days unless a health care practitioner certifies otherwise.
What is licensed
Iowa licenses a handful of businesses, not a market:
| Licence | Who holds it |
|---|---|
| Manufacturer | MedPharm Iowa, Des Moines; Bud and Mary’s, Council Bluffs |
| Dispensary | Five licensed locations, including Council Bluffs, Davenport, Sioux City, Windsor Heights, and Waterloo |
HHS controls how many licences exist and publishes requirements for manufacturers and dispensaries. Because the department sets the number and reviews who operates, a change in ownership or control is a regulatory matter, not a private sale you can close on your own timetable. The general mechanics are on change of ownership approval explained.
Do not read Iowa’s small licence count as scarcity value in the way a capped adult-use state has it. Value follows cash flow, and the programme’s product and dosage limits cap the cash flow. The distinction is explained on license value in capped vs uncapped states.
Consumable hemp
The livelier transaction market in Iowa is consumable hemp. Since 1 July 2024, under House File 2605, a consumable hemp product may not exceed the lesser of 0.3% THC by dry weight, 4 milligrams of THC per serving, or 10 milligrams per container. Synthetic THC is prohibited, warning labels are required, and purchasers must be 21 or older.
Federal rules tighten again shortly. Cannabinoids the plant cannot naturally produce lose hemp status on 12 November 2026, while the total-THC test, the per-container cap, and the converted-cannabinoid exclusion were delayed to 11 December 2026. Anyone buying an Iowa hemp beverage or edible business should underwrite it on the product line that survives both the state caps and those federal dates: see hemp and CBD businesses and hemp vs marijuana: legal distinction for buyers.
What this means for Iowa owners and buyers
If you operate an Iowa hemp company, you are selling an ordinary small business with a regulatory clock attached, and the buyer will want compliance records, lab results, and a product map against both the 4-milligram rule and the coming federal definition. If you want to own a licensed cannabis business, the realistic routes are across the state line: Illinois, Missouri, and Minnesota all license adult-use operators and all vet every proposed owner regardless of residence. Illinois alone recorded $133.2 million of out-of-state purchases in the first half of 2026, part of which is Iowa demand crossing the border. Start with buying a license vs applying for one.

Frequently asked questions
Can you buy a medical cannabis dispensary in Iowa?
Only in principle. Iowa licenses a very small number of dispensaries under chapter 124E, and the department controls how many exist and who holds them. Any change in the ownership or control of a licensee is a matter for the Department of Health and Human Services, not a private transfer. The economics are also constrained by the programme's THC cap and product restrictions.
How big is Iowa's medical cannabis market?
Small by design. Iowa allows no smokable flower and caps most patients at 4.5 grams of THC over 90 days, so per-patient spending is far below what a Missouri or Illinois retailer sees. Two manufacturers and five dispensaries serve the whole state. A buyer should model this as a specialty pharmaceutical-style business, not a dispensary.
Are hemp THC drinks legal to sell in Iowa?
Within limits. Since July 2024, consumable hemp products must not exceed 4 milligrams of THC per serving or 10 milligrams per container, synthetic THC is prohibited, warning labels are required, and buyers must be 21 or older. Federal hemp rules tighten further in late 2026, so any Iowa hemp business should be valued on what it can still sell after those dates.
Should an Iowa owner look at a neighbouring state instead?
Many do. Illinois, Missouri, and Minnesota all border Iowa and all license adult-use businesses, and none requires an owner to be a resident, though each vets every proposed owner. Illinois reported $133.2 million of out-of-state purchases in the first half of 2026, some of it Iowa demand, which is worth understanding before assuming Iowa legalisation would simply add revenue.
